These Terms of Service ("Terms") govern your access to and use of the website phoneline.ai, including any content, functionality, and services offered on or through the website or the Phoneline.ai platform (collectively, the "Service"), which is owned and operated by Nebula Innovations LLC, doing business as Phoneline.ai (collectively referred to as "Phoneline.ai", "us", "our", or "we").

By using the Service, opening an account, or by clicking to accept or agree to the Terms when this option is made available to you, you accept and agree to be bound and abide by these Terms. 3. AI Call Handling and Disclosure

Phoneline.ai provides an AI-powered virtual call agent that may answer phone calls, interact with callers, record or transcribe conversations, and perform related automated actions on your behalf.

You are responsible for ensuring that your use of this Service complies with all applicable laws, including those requiring disclosure that callers are communicating with an automated system. Phoneline.ai may include optional recorded disclosures to assist with compliance, but ultimate responsibility remains with you as the account holder.

4. Call Recording, Transcription, and Consent

Calls handled by Phoneline.ai may be recorded, stored, transcribed, analyzed, or otherwise processed to provide and improve the Service.

By using the Service, you represent and warrant that you have obtained all necessary consent from your callers or contacts to record, store, and process such communications in accordance with applicable privacy and communication laws (including U.S. federal and state two-party consent laws). You acknowledge that Phoneline.ai is not responsible for securing such consent on your behalf.

5. Data Usage and AI Improvement

Phoneline.ai may use anonymized or aggregated data derived from your account activity or AI interactions to improve our underlying models, ensure compliance, and enhance product performance.

We do not sell personal information or share identifiable call data with third parties except as required by law or as necessary to operate the Service (e.g., storage providers, telephony infrastructure).

6. Responsibility for AI Outputs

AI responses are generated based on data you provide or authorize Phoneline.ai to access.

You are solely responsible for reviewing and approving any information, website content, or materials used to train or configure your AI agent. Phoneline.ai does not control or monitor specific conversations between your AI agent and callers, and is not liable for any damages, statements, or actions arising from such interactions or outputs.

7. Third-Party Websites and Integrations

The Service may connect to, access, or analyze information from third-party websites or APIs to train or configure your AI agent. You are responsible for ensuring that you have the rights or authorization to allow such access. Phoneline.ai is not responsible for the content, accuracy, or legality of third-party materials or services integrated through your account.

8. Compliance with Communication and Privacy Laws

You agree that your use of the Service complies with all applicable communication, privacy, and consumer protection laws, including but not limited to the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, California Consumer Privacy Act (CCPA), and any equivalent state, federal, or international legislation.

You agree not to use the Service to place unsolicited or unlawful calls, messages, or communications of any kind.

9. Intellectual Property Rights

The entire content, features, and functionality of the Service—including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof—are owned by Phoneline.ai, its licensors, or other providers of such material, and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

10. Limitation of Liability

To the maximum extent permitted by law, in no event will Phoneline.ai, its affiliates, licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Service, any websites linked to it, any content on the Service, or such other websites, including any direct, indirect, special, incidental, consequential, or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable.

You agree to submit to the personal jurisdiction of the state and federal courts located in Delaware for any actions for which we retain the right to seek injunctive or other equitable relief in a court of competent jurisdiction.
